Mobile Police have confirmed that the gun Andrew Lee Mitchell is accused of shooting at officers with was stolen.
The second suspect in a shootout turned standoff with Mobile Police was taken to jail Tuesday.
Andrew Mitchell faces three counts of attempted murder after a shootout involving Mobile police officers last week.
Last Thursday two Mobile Police Narcotics officers noticed Johnny Vail and Mitchell, walking next to a building in the RV Taylor housing community.
Court documents say that when the officers tried to stop Vail, Mitchell began to fire at officers as they were getting out of their car.
An MPD Sergeant returned fire, hitting Mitchell twice and Vail at least once.
Mitchell fell and Vail ran into an abandoned apartment where he later surrendered.
Mitchell was taken to the hospital for treatment. He was released Tuesday and taken to Mobile Metro Jail.
